Subject and Application of the Terms of Sale

The website liveset.app is owned by the company Cognitechs SA (hereinafter Cognitechs).

These General Terms and Conditions of Sale (GTC) govern the rights and obligations of the parties in the context of the use and online sales offered by the LiveSet application.

Each customer acknowledges having read, understood, and accepted these GTC without reservation.

Cognitechs reserves the right to modify these GTC at any time and to make them accessible on its website. The modified GTC shall take effect on January 1, 2025.
Subscription to a Plan

Any subscription to a pricing plan made through the LiveSet application is considered final and cannot be canceled by the Client once confirmed, except for plans in the form of a subscription with recurring payments. In such cases, the subscription can be canceled at any time, but the cancellation will only take effect at the end of the prepaid period. Canceling a subscription does not entitle the Client to any refund, even partial.

Any subscription from a Client with whom a dispute exists, such as over a payment obligation, will be refused, and the Client may not claim any compensation.

The computerized records (traces, logs) of Cognitechs are considered proof of communications, subscriptions, and payments between the parties.
Prices and Payment

The prices indicated are expressed inclusive of all taxes.

For transactions made by credit card or any other payment method, the purchase price is immediately debited upon confirmation of the subscription.

Prices may be changed at any time without prior notice. However, for determining the price, the moment of the Client's order confirmation is decisive. If the price of a subscription is modified, the Client will be given one month's notice to decide whether to accept the new rate or cancel their subscription.

Payment is made at the time of subscription online via Stripe.

All online payments made by credit card are processed on a secure server. The relevant information (e.g., credit card number and expiration date) is encrypted during Internet transmission and does not pass through the LiveSet website.

In the case of payment via the Stripe server, the General Terms of Stripe apply: http://www.stripe.com. By confirming an order, the Client declares their acceptance of Stripe’s General Terms.
Data Protection

Subject to any contrary provisions in these GTC, Cognitechs acknowledges the confidentiality of data collected in the context of a subscription to a pricing plan. This data is collected, processed, and used to fulfill contractual obligations arising from the sales agreement. It is processed with complete confidentiality and is not disclosed to third parties. The Client consents to their personal data provided in the contractual relationship with Cognitechs being stored by the latter.

The Client must register on the website with a username and password to place an order.

Cognitechs reserves the right to delete the Client's data or block a username and password at any time and without explanation.

For further information related to the management of personal data, the Client should refer to the Privacy Policy outlined in the Privacy Policy document.

Cognitechs reserves the right to occasionally send newsletters or mailings to its Clients, informing them of updates and new features.
Intellectual Property

Cognitechs holds all copyright rights under applicable legal provisions protecting the website and its content, such as the logo, texts, elements, photos, graphics, etc.

Without prior written consent from Cognitechs, it is prohibited to copy, reproduce, download, use, or publish any of the content on this website. Exceptions include special links available for download, such as sample scores directly integrated into the application.
Miscellaneous
- Cognitechs cannot be held liable for any damages, whether material, immaterial, or physical, resulting from the misuse of the software or generated files.
Applicable Law and Jurisdiction

These GTC govern the relationship between the Client and Cognitechs. Beyond these terms, their relationship is subject to Swiss law, particularly the Swiss Code of Obligations, which governs aspects not expressly mentioned in these GTC.

In the event of a dispute, the Client shall first contact Cognitechs to seek an amicable resolution.

The place of jurisdiction is Geneva (GE), Switzerland.
